Today on Insight, John and Josh Rosenstern discuss a recent Supreme Court ruling that made a Louisiana abortion law unconstitutional. Brother Josh explains how the law limited where doctors could perform abortions in the state of Louisiana. The District Court recognized a similar Texas case; but the Circuit Court said no, there were major differences; but ultimately, the Supreme Court, voted it unconstitutional by a 5 to 4 vote. The Supreme Court’s ruling will allow more access to abortions. Conservative Chief Justice John Roberts had the swing vote, and joined with the liberal side. Brother Josh said they determined that the women who have true medical needs seeking an abortion experience undue burden if they cannot find a medical facility nearby that performs abortions. The law restricted the number of doctors that could provide abortion services causing women to have to go out of state. However, the Rosenstern’s say, in the majority of cases, abortions are not based on a woman’s medical safety. Brother Josh says the surprise was the vote by conservative Justice Robert’s. He says because the Texas case looked like the Louisiana case, likely Robert’s concurred that a precedent had already been set in Texas. Brother John worries that the Supreme Court is leaning toward making law, which it is not suppose to do. Brother Josh says let’s go back to Roe Vs. Wade, the true problem is, we have removed the consequence for an act of murder.
